1. Introduction

These Terms govern offers and sales of Enerlith and related goods through the Site. They form a contract between you ("Buyer") and the Seller. Mandatory consumer protection laws in your country of residence may grant rights that cannot be waived; where a clause conflicts with such laws, the mandatory rule prevails.

2. Language and filing

The contractual language is English. After you place an order, we send a durable confirmation summarising key terms. You should retain that confirmation together with these Terms and the Privacy Policy.

3. Product information

Descriptions emphasise physical characteristics, ingredients, and regulatory statements suitable for food supplements. Photography may show props that are not included. Pack shots are indicative; minor packaging changes by manufacturers do not entitle you to reject goods unless they affect ingredient composition or mandatory label text.

4. Eligibility

You must have legal capacity under applicable law. Business buyers warrant that purchaser details are accurate for VAT invoicing.

5. Ordering process

Product pages display an invitation to treat. When you submit an order form, you make an offer. We may accept by sending an order confirmation or by shipping goods. Automatic acknowledgments before manual fraud review are not final acceptance. We may decline orders linked to failed payment, export restrictions, suspected abuse, or stock unavailability.

6. Prices and taxes

Listed prices use the euro unless another currency appears at checkout. Prices include VAT when required for your destination. Import duties, brokerage fees, or local recycling charges may be billed by customs or carriers for deliveries outside the customs territories we describe at purchase. Promotional references such as from €59.90 to €39.90 indicate marketing comparisons, not historical statutory prices everywhere.

7. Payment

Payments are collected through certified processors. We never store full card numbers on Seller-controlled infrastructure. If payment fails, fulfilment pauses until settlement or cancellation.

8. Shipping and risk

Risk transfers according to Incoterms stated in checkout, defaulting to DAP place of destination unless customers choose a different offered service. Insurance covers carrier liability limits; contact us before purchase if you require extended coverage.

9. Legal guarantees and safety

Consumers in Norway and other EEA states benefit from statutory conformity guarantees under Directive (EU) 2019/771 and national implementations. If goods lack conformity, you may seek repair, replacement, price reduction, or termination according to law. Food must be safe under Regulation (EC) 178/2002; report suspected issues with batch codes.

10. Right of withdrawal

Consumers generally have fourteen days to withdraw from distance contracts under Directive 2011/83/EU. Sealed goods unsuitable for return due to health protection reasons are exempt once unsealed after delivery. See the Return Policy for instructions.

11. Intellectual property

Trade dress, Enerlith naming, Site layout, photography created by Seller staff, and marketing copy remain Seller intellectual property. You may not scrape, mirror, or frame the Site without consent.

12. Acceptable use

You may not interfere with security, distribute malware, harvest personal data of other customers, or misuse promotional codes. Violations may trigger suspension, chargebacks recovery, and legal injunctive relief.

13. Limitation of liability

To the extent permitted lawfully, Seller liability for direct damages is limited to the purchase price of the affected order. We exclude indirect or consequential damages except where such exclusion contradicts binding consumer statutes. Nothing limits liability for gross negligence, willful misconduct, or statutory non-waivable guarantees.

14. Force majeure

Events beyond reasonable control—strikes, wars, embargoes, pandemic restrictions, energy shortages, or supplier insolvency—suspend performance for the duration. We credit orders we cannot fulfil within a commercially reasonable extension.

15. Assignment

Seller may assign receivables to financing partners. Buyer may not assign claims without consent.

16. Dispute resolution

Norwegian buyers may use the Consumer Council (Forbrukerrådet). EU residents may access the Online Dispute Resolution platform. Nothing prevents either party from bringing proceedings in courts with jurisdiction under Article 18 Brussels I Recast for consumers.

17. Governing law

For business buyers, Norway governs substantive law unless imperative rules designate otherwise. Consumers retain the protections of laws in their habitual residence.

18. Complaint handling

We log complaints in a ticketing system with severity labels. Consumer complaints receive an initial substantive reply within five business days unless complex investigations require longer, in which case we send interim updates every seven business days. Business complaints follow service-level agreements stated in quotations.

19. Product recalls

If regulators or internal audits identify unsafe batches, we publish recall notices on the Site, email affected buyers, coordinate carrier collections, and document destruction certificates. Regulatory references will accompany official notices required in your jurisdiction.

20. Data protection in orders

Personal data attached to purchase orders is processed according to the Privacy Policy. Marketing permissions never override checkout data minimisation rules.

21. Export controls

Buyers warrant that destinations permit import of food supplements containing listed actives. Prohibited destinations trigger order cancellation without penalty beyond refund.

22. Severability

If a provision becomes void, remaining provisions stay enforceable with modifications narrowly tailored to preserve economic equilibrium.

23. Entire agreement

These Terms, the Privacy Policy, cookie choices, and order-specific confirmation emails form the entire agreement for B2C sales unless mandatory law requires additional pre-contractual documents.
